Elk Creek "Tubes" posted???????

Fished today ended up fishing in tubes getting a few.
On my way out spoke with a guy who said he heard some guys got "kicked out" of the tubes or just below them this morning.
Story goes the owners posted the land yesterday and kicked some guys out today.
I know there has been posted signs down there since last year but thought the property owners were just not allowing parking and you could still walk in and fish it.
I hope its all just another "fish story" anyone have any info???????????

Guy was hanging signs today at about 11 am from the tubes down to the concrete slabs. The guy hanging the signs said he wasn't the landowner. He said that it's going to be pay to play. Not sure if that's true or not. He also said the landowner that owns from the slabs down to the rt 5 bridge will be posting his section soon.

Heard it was the guys at trout run bait n tackle that is leasing up the area there. I think the owners are from out of town but some local guy is helping them with it, not sure though. I won't be going there anymore for tackle!

Definately confirmed that the guys at Trout Run Bait and Tackle paid the landowner to shut it down. Rumor has it that they are trying to get it posted all the way down to the route 5 bridge. All I can say is Elk Creek Sports Store and Poor Richards are open for business!

Thanks for the replies.
Bad news not happy about it but not surprised either.
I shop Poor Richards they are always open and run a good shop.
Can anyone confirm the upstream border of this property,is it up to the tubes or including the tubes????
Keep this and other access loss in mind when your fishing be courteous to landowners and neighbors pick up litter instead of dropping it.....

Unbelievable!  Guess I won't be giving any of my business to the trout run store anymore.  I've stopped in there about a dozen times a year in the past.  Poor Richards is close enough, so I'll just drive down the road for whatever I need when in the area going forward.

I didn't see anyone post it so I'm asking. I was under the impression that even if someone owns the land, they don't own the water and as long as someone waded from legal, accessible water, they could fish posted land if they remain in the water. True, not true? Thanks!

Your post is completely false as D-Nymph stated.  The only situation where your post holds any truth is in the case of navigable waterways.

I'm suprised someone hasn't posted it before now. Pretty soon, all of the private land will be posted by landowners jumping on the bandwagon. In this economy, I guess you have to make money any way you can.

PA needs a stream access law similar to Montana, or at least something similar limited to streams that get stocked with publicly funded resources:

"Under the Montana Stream Access Law (1985), the public may use rivers and streams for recreational purposes up to the ordinary high-water mark. Although the law gives recreationists the right to use rivers and streams for water-related recreation, it does not allow them to enter posted lands bordering those streams or to cross private lands to gain access to streams."

The only one to blame is the state...

Creating and marketing an Amusement park of an artificial fishery on private property.... this was bound to happen

all posted/private water = nursery water with no fishing
want privacy and tired of the unwashed masses.... there is your fix

Maybe we can construct an artificial barrier at rt 5 preventing upstream passage of the artificial tax paid for fish so they cannot be privatized by someone seeking to generate income from our artificial fishery.

I like the Montana stream access law better.  If a land owner wants privacy and is tired of the masses, then they should sell their land and move somewhere near by a smaller stream that doesn't get stocked.  The land value increase due to the publicly funded resource put there would more than pay for the cost of relocating.

It wouldn't be nearly as bad as the state coming in and putting a new highway next to their property, or a neighbor selling gas rights to a fracking company who sets up a well on the edge of their property.

KJH's idea is actually feasible, PFBC could declare nursery waters if they wished.

SteelSlayer's idea would affect the entire state & it's just not possible.

I believe at one time when we discussed the nursery water option. WCO said that would not be feasible. (can't remember why). PA does use and posts certain sections of certain streams in the ANF as " fish refuge area" with no fishing or wading during a set period of time.

Under 58 Pa. Code §67.2 (relating to refuge areas), the Executive Director of the Fish and
Boat Commission (Commission), with the approval of the Commission, may designate waters as
refuge areas to which section 2306 of the Fish and Boat Code, 30 Pa. C.S. §2306 (relating to refuge
areas), shall apply. Section 2306 provides that the Commission may set aside, in its discretion, such
areas as it may judge best as refuge areas in which fishing or entry shall be prohibited for such
periods of time as the Commission prescribes. According to the regulation, the designation of waters
as refuge areas shall be effective upon posting of the waters after publication of a notice that the
waters have been so designated in the Pennsylvania Bulletin.

That would be awesome if these greedy jack****3$ paid a bunch of money to have people post their property to make money off fisher folks, then it got deemed nursery waters. THAT would be true justice.
