Oak Orchard Access

Orleans Co. reached a multi-year lease agreement with the landowner who had posted up sections of the creek. With in the next couple weeks all posted signs and wires across the stream will be removed and access will be open to the public.
 
Access will still be at the two points Dam, and DEC walk in at the bottom of the wadable area.

    Why would they reach an agreement on property that wasn't his? They couldn't have been wrong the whole time and been telling people to trespass on private property. County attornies are infailable like the pope and like GOD their word is the final authority and can't be changed.
    Good for all if it is now legally taken care of.

    Heard a bunch of 'nooks were rolling at the pierheads on Wednesday am.  Verification???????

    Could be that they simply found it more cost effective to sign a lease, than keep arguing the case in court. Either way access has been secured, so it's all good.

    And taken care of as it should have been from the start KD. The BS from the county attorny made a huge mess even bigger. Now 3 years later we get the same ending we could have had back then without all the basd blood created along the way. Kind of reminds me of the end of the Viet Nam war. Waste years and 1000s of lives needlessly and end up with the same results anyways.
    I personaly fish there once every couple of years but I'm glad the county finally came to their senses.

    Isn't that the way it goes this time of year.  The inversion that occurred the last week in August definately brought salmonids closer to shore, and from past experience, you could see tons of rollers at dawn, and nothing an hour later.  Suffice to say that with inshore temps back to 66, it will take a cool off or another strong south wind to bring then in close again.
     
    As to the Oak access, I can think of at least two people who are probably not happy, and for pursuing what probably appeared to them to be a legitimate business opportunity, especially in light of pay to fish operations and private club waters on other quasi-public waters in NY.  Now if we could only get Oswego County to go after public access to the Salmon River.  $30/day for  14 hours 5 months of the year isn't public access.

    Don't think it just appeared to be a legitimate bussiness venture but was one.Since the state agreed to pay it seems they now KNOW Mr Salmon had legal right to the property. To bad it took the state this long to do the right thing. If they would have leased the access 20 years ago when they first could have rather than having some local CA tell people they had the right to fish there a lot of hard feeling could have been saved.
    Spoon, maybe M Jackson paid the 26 million dollars to end speculation about his dealings with children also?

    I am just saying that being in the right is not always enough. Lawyers, and their clients have to consider more than just the strength of their case, and that of their opponent. One is the financial resources of each, to endure a lenghty, and costly process. Another is the mindset of the community, and potential judges, and jurors. I think that there is increasing pressure on judges, and a more protective attitude among jurors to lean toward the landowner in property rights cases. Remember that these folks are far more likely to be landowners, than anglers. A resolution that serves the interests of both parties, can't be ALL bad.

    It doesn't matter whether the jury was fishermen or landowners. A judge would instruct that they decide on the evidence presented and nothing more. He also has a right to vacate their decision if he feels they did otherwise.
    I am sure the state has more money than Mr Salmon to persue this and have not worried about spending it before now. The only way I can read this is that they know Mr Salmon has a legal claim and they could not win in court.
    Of course this settlement is a good thing but it should have been done decades ago.

    Decades ago these creeks were conduits for S**t flowing from towns, farms, hamlets and industries (maybe they still are!! Read young guru on the WNY Board, he's seen his share of toxic waste!).

    Get used to it!! It's called the New Fuedalism!! Properties in the ADK that were 200k three years ago sell over a million today.  Wait until you feel the pain of all that social security you've paid into going away!!!

    13 decades ago was 1987 now. There were plenty of fish in the Oak at that time as you well know. People were already stealing the rope Mr Salmon ran down the hillside in front of his house back then. And not putting anything in the little donation box by his mailbox.
