Here's another question.  How liable is a landowner, who grants access for fishing, if an accident occurs to a fisherman on their property.   This one I'm not too sure about.

Here's another question.  How liable is a landowner, who grants access for fishing, if an accident occurs to a fisherman on their property.   This one I'm not too sure about.

Well, do you remember a couple of years back when that landowner was getting sued over a girl that was shot. She was walking by and somebody who they gave permission to hunt there shot her by accident. I don't think the courts ruled in the girls favor, but it was close.

I'm not real sure either on this one, but here's the way I look at it! If somebody's child was hurt playing on my son's swing set they could sue, and most likely win.

So technically, with a good attorney, they could sue you if they got hurt on your property!

But to answer the original thread's question!

I would not post it!

i'll throw another idea in the mix

what if I offer you $15,000 a year to post your section of the stream and only allow certain people to fish it???
nothing like the history and bad-blood people like DB or KW

maybe one of the following
- people i guide
- maybe just me and 10 of my friends
- maybe me and the 25 members of my trout club (ethical and clean fisherpeople)

You paid for it, you do what you want with it...Either way, It'd be sad to see some land acquired then posted and never get utilized for it's fishing opportunities.

RE: Serious question 2008/11/17 20:30:38 (permalink)
It is a stocked fishery, paid for by sportsmen's dollars.  I would keep it open until I could no longer tolerate the poor behavior exibited by anglers.  I would like to think that I would have researched the property well enough to know that this would/should never be a problem right out of the gate.  On the other hand... I might shut it down for a week if a big buck was cruising my stretch and the rut was on...

My family does own a portion (both banks) of a native brookie stream.  Unfortunately, we have closed it down as have the neighbors for the entire length of the stream.  Now the restrictions to fish it are tight.  This was entirely due to angler behavior.  The difference is that the fish maintain themselves, and there is no state assistance to stock these fish or maintain the fishery.

Im on the fence especially in the early season when your shoulder to shoulder and you think to yourself how great it would be to have your own section of  stream.  But on the other hand when I walk downstream from Folly's and hit posted signs and wish that i could go a littlebit further but cant.  Man that looks like a good section of stream.

I would love to be able to keep a section of stream open for families only (If I owned property). Imagine a section of stream just for kids and their parents/grandparents to enjoy. I believe it would be a great way to get more children involved in this great fishing experience. Hopefully the adults involved would teach their kids how to take care of the land, stream, and the big fishys.

My sign would read:

Leave only footprints, enjoy and share, memories are priceless!

OK, I changed my mind, I would open it to snagging only, so Tippee, heater and Otter could have there way with them. :)
