posted property

today we parked at folley's on elk and fished down about a 1/4 to 1/2 mile and ran into a cable stretching across the creek that said notrespassing. This sign was not there the last time we fished this stretch. can anyone tell me what this is all about?

    That usually indicates private property. That means the landowner does not want you on their land. That's what I know about it.

    Deer season had a part to posting it in the past. Stayed off that strech ov crick for some yrs. now even though some guys told me it was for rifle season only. But to me posted means stay out.

    That cable's been there since last season, not because of hunting season.  The guy at the top of the hill does not want anyone fishing there without permission.

    The guy's name is Al that has that property it says what it means and he will kick you out real fast and who ever has permission will kick you out to(at his request) he has had alot of problems with guys messing up his property and everyone that has permission was told to stay away during deer season. Al is a nice guy overall and I think if you just ask him if you can fish he might let you. hope that helps

    Its amazing that some folks just cannot accept the fact that posted signs go up everyday...Its even more amazing how some totally ignore them as if they don't understand what they mean.  The signs will continue to go up as the litter continues, the stampeeds continue and the ignorance persists.  I'm not a landowner, but I know some and they are getting tired of all the BS and so would I.

    Whats it all about?  It means stay the "F" out or go get permission from the landowner to be on his/her property!  That simple.

    This is the third season for the cable.  You must not fish that area often.

    I dont understand about private property, cause i was told a while ago a by the fish commission that if you stand in the creek you are ok cause the landowner does not own the creek itself. because the creek is pa fish commission water. was anybody else ever told that.

    What waters are considered to be private?
    Private waters are non-navigable rivers, streams and lakes.
    Who owns private waters?
    Title to the beds is held by the adjacent riparian landowner. If the adjacent riparian landowner owns property on only one side of a non-navigable waterway, he or she owns to the middle. When a non-navigable waterway flows through someone’s property, he or she owns the entire bed of the waterway.
    Can a riparian landowner prevent members of the public from fishing or wading in a non-navigable water?
    Yes.
    Can a riparian landowner prevent the public from boating or floating in a non-navigable water?
    No, because there’s a “navigation servitude” that gives the public the right to use the water for purposes of navigation only. This servitude does not extend to fishing.
    Can a riparian landowner string a cable across a non-navigable waterway?
    Yes, as long as:
    1. the landowner owns property on both sides of the stream; and
    2. the cable doesn’t interfere with navigation.

    However, from a liability perspective, it may not be a good idea.

    My land, along a stocked trout stream, was open to fisherman for many years. A few years ago, the weekend after opening day of trout, someone ripped the doors off of my garage and stole more than $10,000 worth of quads, power tools, and other stuff. Some of it I was storing for my neighbors. Thats when the posted signs went up.

    Rhnstn, Believe me when I say this, I understand fully why you posted it. The saddest thing is for everyone else, lost access to a stream and the perpetrators probably weren't true fisherman. But I do understand it is not worth it to have strangers running through your property non-stop. It is just sad that it comes to that after you allowed fishing out of decency until you virtually got screwed. Probably never caught them either.

    It depends if the water is considered navigable or not.

    In navigable waters you are okay as long as you stay in the stream / river bed. That's the case in many states. But in PA, only a handful of waterways are considered navigable. None of them are in Erie County (except Lake Erie itself).

    In states like Montana, you are allowed to walk/float/fish within any waterway as long as you stay within the high water marks. Not only that, you are allowed to cross private property to reach any such water.

    States like PA have a lot of catching up to do.

    As for me, I go where I want and do what I feel. If someone wants me to leave "their" land, they'll have to physically remove me.

    This all sounds fine and dandy to you now.  However, if you ever make some money and purchase some land you will change your tune rather quickly.  The only people who believe this way are those who can't afford or put in the effort to be able to afford such things.  This is why only land owners should be able to vote!
