Godfrey Run Shore Fishing Could Be Gone

Overheard a conversation  today that PENNDOT is trying to give the road that goes down over the hill to the lake shore at Godfrey Run to the Fish Commission, but apparently the PFBC does not want it.
 
If PENNDOT abandons the road, it goes back to the property owners who will surely post it and close access to the lake by walk in fishermen.

    It doesn't automaticly go to the property owners however they can claim it. Then they would have to get new deeds written and recorded and then they will be taxed on the increased lot size. Alot of BS for most people....WF

    Maybe someone will ask John Arway about this at the PSA meeting tonight,then we will have the straight dope.

    Ya we go down and talk to that guy alot, he is a very nice person. He also goes to shows and has written several books on wood sculptures. Plus the stuff he sales isn't cheap, he walks the shore lines for miles and picks stuff up. Its all profit to him. Next time he is there you should go in and see some of the stuff he makes ............ Flatfish

    I spoke with the PF&BC folks at tonite's PSA meeting. While PENDOT may "abandon" the road for maintenance puposes, it still remains a public right-of-way. Also the PF&BC IS one of the landowners along that road. The other landowners could not take action, that would deny access to that property.

    The PFC is only giving you half the story. PENNDOT can get rid of a road two ways, abandon it or vacate it. Maybe I should have been more specific. When PennDOT vacates the road it is no longer a public right of way. It automatically reverts to the property owner all the paperwork is filed by the state. The Properety only has to sign on the dotted line to reclaim their property. The Fish Commission owns a very, very small piece of land near the shoreline. They cannot be denied access to their property true, but the property owners can erect a gate, fence, etc. and provide the PFBC with a key for acess. They can further require the PFC to tell them when they want to access their property, and unlock the gate for them. Since the PFC no longer uses Godfrey Run to take fish out of there they would be hard pressed to show just cause to have full time, unrestricted access. That is all the property owners are legally required to do. They do not have to allow anybody other than a property owner access. As fishermen we do not own the property. My uncle was involved in one of these deals in Cameron County. The threat is real that the access to fishermen could be taken away. The PFC is not giving you the whole truth. Why wouldn't they want to own the 700 feet of access road and preserve access to the lake anyway?

    As was stated, a vacation and and abandonment is two different things. The township or borough may have rights to the roadway also. I can't see Penndot spending any money to appease a property owner who wants to make a claim on the section of road. Also the municipality or county surely wants their share of any tax revenue they could get from the property owner. Ain't gonna say that Penndot will not do all the work for a lot owner to get the land but I have never seen it happen in my years as a surveyor....WF

    Who cares!?!!? Give the "wood sculpture" guy some peace...God knows, he deserves it after all these years. Its not that good a spot anyhow!
