Federal Ban on all lead in fishing tackle under the Toxic Substances Control Act
September 2, 2010

Dear Cabela's Customer:

Occasionally, an issue of such importance arises we feel it necessary to contact our loyal customers. With our fishing rights at stake, this is such an issue.

On August 23, 2010, the U.S. Environmental Protection Agency was petitioned by the Center for Biological Diversity and others to ban lead from ammunition and fishing tackle, including sinkers, jigs, weighted fly lines and components containing lead, such as brass and ballast in lures, spinners, stick baits and other fishing products.

On August 27, the EPA denied the petition regarding ammunition, but let stand the petition to ban lead in fishing tackle and has opened a short period for taking public comment.

Such a ban would cause prices of fishing products to skyrocket. Alternative metals can cost from six to 15 times more than lead, and most do not perform as well. For many, fishing would no longer be the affordable sport it is now.

Please join Cabela's and Keep America Fishing in opposing this ban by submitting your comments to the EPA no later than September 15, 2010. You can easily do so by clicking here.

It is a fast and easy way to assure your opinion is heard.

Cabela's is working in conjunction with the American Sportfishing Association and Keep America Fishing to protect our tradition and heritage of fishing.

Thank you for your help.

Sincerely,

Cabela's

    Since May 2004

New York State passed legislation that will prohibit the sale of certain lead sinkers. Beginning in May 2004, the sale of lead fishing sinkers (including "split shot") weighing one-half ounce or less will not be permitted.

The new legislation (Environmental Conservation Law, Section 11-0308) regarding the ban of sale of small lead fishing sinkers states:

S 11-0308.* Sale of small lead fishing sinkers prohibited.

1.No person shall sell at retail or offer for retail sale lead fishing sinkers weighing one-half ounce or less. Each day of sale or offering for sale shall constitute a separate violation of this section.
2.For the purposes of this section, the following terms shall have the following meanings:
a."sinker" shall mean any device that is designed to be attached to a fishing line and intended to sink the line. Such term shall bb."sell at retail" or "retail sale" shall mean the sale to any person in the state for any purpose other than for resale.
3.The department shall provide notice of the prohibition of the retail sale or offering for sale of lead fishing sinkers weighing one-half ounce or less in the state fishing regulations guide.

Is it still under a certain weight? I was at All Season Sports in Pulaski a couple years ago and watched the one clerk attach a row of lead split shots to a leader and sell it as a drag weight or something like that.
