Sunday hunting on the move

Word is the Pa Farm Bureau has decided to back off of their strong opposition to any legislative action transferring regulatory authority of Sunday hunting to the PGC. This certainly lessens one of the big roadblocks that has plagued past bills. When our state legislature reconvenes after the holidays, there is a good chance of some real movement on this issue.

    SB147 introduced by Senator Laughlin on 2/1/18 gives full authority of Sunday hunting to the PGC and also toughens our trespass laws. 
     
    Heard from a reliable source that this bill will move.

    Will be interesting to see "if" trespass laws are changed and "just who" the new laws will favor. Trespasser or landowner?

    Will landowners now need to (properly) post their land or will the trespasser need written permission to 'trespass', posted or not?

    INTRODUCED BY LAUGHLIN, BREWSTER, STREET AND YAW, FEBRUARY 1, 2019 REFERRED TO GAME AND FISHERIES, FEBRUARY 1, 2019 AN ACT Amending Title 34 (Game) of the Pennsylvania Consolidated Statutes, in hunting and furtaking, further providing for hunting on Sunday prohibited, providing for hunting on Sunday and further providing for trespass on private property while hunting. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Section 2303 of Title 34 of the Pennsylvania Consolidated Statutes is amended by adding a subsection to read: § 2303. Hunting on Sunday prohibited. * * * (d) Expiration.--This section shall expire upon the publication of the regulation under section 2303.1(b) (relating to hunting on Sunday). Section 2. Title 34 is amended by adding a section to read: § 2303.1. Hunting on Sunday. (a) General rule.--The commission may institute Sunday hunting by regulation promulgated in accordance with section 2102 (relating to regulations). 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 (b) Applicability.--It shall be lawful for a person to hunt for any furbearer or game on Sunday on and after the publication of the final regulation under subsection (a). Section 3. Section 2314 of Title 34 is amended to read: § 2314. Trespass on private property while hunting. [(a) General rule.--Any person who while violating any provision of this title or any regulations promulgated under this title and who in addition is found to be trespassing as defined in 18 Pa.C.S. § 3503 (relating to criminal trespass) shall be in violation of this section. (b) Penalty.--A violation of this section: (1) A violation of this section is a summary offense of the fifth degree. (2) A second or subsequent violation of this section within a seven-year period is a summary offense of the fifth degree and may result in forfeiture of the privilege to hunt or take game or wildlife anywhere within this Commonwealth for a period of one year.] (a) General rule.--A person, while engaged in hunting or furtaking, commits an offense if, knowing that the person is not licensed or privileged to do so, the person: (1) enters or remains on any land of another without authorization to do so, when the land is posted in a manner prescribed by law or reasonably likely to come to the person's attention or is fenced or enclosed in a manner manifestly designed to exclude trespassers; or (2) enters or remains on any land of another without authorization and defies an order not to enter or to leave that has been personally communicated to the person by the owner of the land or other authorized person. 20190SB0147PN0125 - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 (b) Penalty.--An offense under this section shall be graded as follows: (1) A person who violates subsection (a)(1) commits a summary offense of the third degree.     Not that I think it will come to it (I hope) but I do wonder if specific rules/regs will need be met by the landowner in order to properly post, fence, or otherwise protect/stop unwanted trespassing.

    Such regulations could become costly, timely and even dangerous at times.

    Nothing like facing an irate (I have a license) hunter having a loaded firearm, and tell him to leave ones property.

    whoopee...Sunday hunting and more No Trespassing signs coming ....  I see no big gain.

    Looks like this bill is being fast tracked. Just introduced a few days ago and the Senate Game and Fish Committee is meeting tomorrow to consider it. Word is it will move out of committee into the floor of the senate. We will see tomorrow.

    Game and Fish vote was delayed till 1:00pm today. Apparently the NRA position has caused some to pause for a bit to evaluate their vote.

    I have sent emails to all on the Senate G&F committee in favor of the repeal...at least those that had their email's listed.  There were a few that did not.

    It just passed out of committee. There is a strong desire to bring it to the floor for a vote. Getting a Sunday hunting bill out of committee is a big accomplishment. We are in new territory now.

    dpms , After trying to understand the bill that you mentioned I can see why little gets done in meetings of the pfg & the pf&bc. Imo it is a slap in the face for the lawmakers to expect our agencys to enforce trespass laws when there is already means to enforce such laws,such as the State Police. If people want to post their lands that is their right to do so,but to expect hunters & fishermen to enforce those laws when our agencys are shorthanded & the lawmakers won't provide more resources does not sit well with me. I have let my reps. know how I feel & that I vote how I believe. Personally I feel that the Pa. Farm Bureau should pick up the slack since they always seem to want to tell hunters what to do.   sam
