HOUSE BILL
No. 2285 Session of 2008



INTRODUCED BY CUTLER, KORTZ, BAKER, BOYD, CAUSER, FLECK, HELM,
HERSHEY, HICKERNELL, MENSCH, METCALFE, R. MILLER, MILNE,
MOUL, MOYER, PALLONE, PYLE, SONNEY, STERN, SWANGER AND TRUE,

AN ACT

Amending Title 34 (Game) of the Pennsylvania Consolidated
Statutes, further providing for powers and duties of
enforcement officers.

The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 901(a)(6), (7) and (8) of Title 34 of the
Pennsylvania Consolidated Statutes are amended to read:
§ 901. Powers and duties of enforcement officers.
(a) Powers.--Any officer whose duty it is to enforce this
title or any officer investigating any alleged violation of this
title shall have the power and duty to:

(6) Stop and inspect or search, [at any time] if
probable cause exists, any means of transportation within
this Commonwealth. Any officer who stops any means of
transportation shall be in uniform and present a badge or
other means of official identification and state the purpose

of the inspection or search.
(7) Inspect and examine or search, [at any time or
place] if probable cause exists, any person or means of
transportation or its attachment or occupants, or any
clothing worn by any person, or any bag, clothing or
container when the officer presents official identification
and states the purpose of the inspection or search.
(8) Inspect and examine or search, [at any time] if
probable cause exists, any camp, tent, cabin, trailer or any
means of transportation or its attachment being used when the
officer presents official identification to the person in
charge and states the purpose of the inspection or search.

Section 2. This act shall take effect in 60 days.

    key word here is probable cause just another means of harassment.I don't see any bill for the law abiding person with a concealed carry permit to carry in any of our state or national parks while camping or hiking.
    let us not forget the slug that killed that lady hiker in ga. i do believe just to rob her for her money and credit card.stand back people keep your mouthes shut and watch your rights be taken away.IT IS WE THE PEOPLE NOT WE THE GOVERNMENT!!!!!!

    this was discussed on other forums.  All this bill does is ammend title 34 (the game code) to reflect waht the courts have upheld.  Yes, the game commission has been able to stop and search you and your vehicle if they believe you are hunting.

    I guarnatee you ----

    they will NOT search my truck without my permission...

    even the state police can't do that....

    They tell ya they can and most folks get all excited and don't know any better and "give in" and say okay... go ahead and see what you can find !!!!!!

    They can look in the windows that's it..... unless they see something in plain sight that violations or MAY violate a game law...

    I think it says "if probable cause exists."
     
    Correct me; state police with probable cause can search?  I always thought so..

    My reports and advice are for everyone to enjoy, not just the paying customers.

    I have been told several times by state police that WCO's had more authority to search than they did.

    Better too far back, than too far forward.

    Example....

    A WCO who suspects you of poaching can not just ask you to open your trunk,,, well he CAN ASK..but you do not have to....

    Let's say he sees fresh blood on the bumper..... now that would provide probable cause.... and you may not be able to refuse his request,,,

    but just his "thinking" or "suspecting" (i.e. his guess) you are
    hunting/poaching is NOT enough....
