Yeah, forums are privately owne, which is a point that many users fail to realize (not saying anyone here, but I've run into that ALOT elsewhere). Qualifications for being a Mod are that the powers-that-be see fit to make you one. A message board's quality is directly proportional to that of the Mod staff. If you've got admins playing favorites and dirtying their hands in squabbles between users, those users feel more important and will trigger squabbles just to get attention. By the same token, Mods that tend to stay aloof, and keep discipline private, low-key, warned of, and non-negotiable tend to end up with a group of well-behaved users. Not saying they cant participate in threads, but more like they shouldn't participate in arguments. Notice I didn't say that Mods have to be consistent. I know that, at least for the boards I Moderate for, we have a subjective response policy, meaning we are instructed to address each situation as we see fit. It might help to refer to the way you handled a past issue, but you're not bound by an earlier decision in terms of how you handle this one. Almost any time something happens, you'll get a complainer waving his free-speech flag. Well the truth is, the internet isn't America, and users dont have any real rights in terms of a site owner's actions on his own site. If an admin wants to ban you because he's grumpy that day, well that's how it goes. The flipside is, of course, that you dont pay him to use his board, and you're free to leave whenever you like.
