Commission Votes to Acquire Erie County Properties, Adopts Regulations to Slow Aquatic Disease
Harrisburg, PA, 10/7/08 — During its fall quarterly meeting on Tuesday, the Pennsylvania Fish and Boat Commission (PFBC) voted to pursue three properties in Erie County in order to enhance public fishing opportunities and approved final regulations aimed at slowing the spread of an infectious disease found in a variety of fish.
The Commission voted to allow staff to pursue the acquisition of public fishing easements on three properties along Elk Creek in Erie County. Once the easements are acquired, they will provide access to 8,700 linear feet or 1.65 miles of stream along Elk Creek. Property acquisitions or easements typically take six to twelve months to finalize after formal Commission action.
Properties or easements in Erie are purchased through the proceeds from the sale of the Lake Erie permits and from $6 of the fees collected from the combination trout-salmon/Lake Erie permits. The funds are deposited into a restricted account and are used to provide public fishing access on or at Lake Erie and the tributaries to Lake Erie. The Commission also adopted final regulations and amendments, effective Jan. 1, 2009, dealing with Viral Hemorrhagic Septicemia (VHS), an infectious disease affecting fish in Lake Erie and many other lakes in the Great Lakes watershed. The disease can be spread to other waterways through live baitfish, fresh fish eggs, live fish, bilge and bait bucket water and uncleaned fishing gear or boats.
The new regulations and amendments address the sale, introduction and transportation of VHS-susceptible species of fish, dead or alive, and their parts. They do not address eggs. Specifically, the new regulations and amendments make it illegal to sell, possess and use as bait or otherwise introduce VHS-susceptible species of fish taken from the Lake Erie watershed in other watersheds of the Commonwealth, unless the fish are from a group of fish or from a propagation facility that has been as certified as having tested negative for VHS in accordance with tests adopted by the Pennsylvania Department of Agriculture and approved by the PFBC. Under current regulations, it is already illegal to transport these fish unless certain conditions are met.
The new regulations and amendments also make it illegal to sell and introduce VHS-susceptible species of fish into Pennsylvania from a VHS-affected or VHS-at risk state unless the fish are from a group of fish or from a propagation facility that has been certified as VHS-negative. There are similar restrictions on the transportation of these fish. In addition, these fish may be transported into the Commonwealth if they are dead, recreationally caught fish that are being transported solely for human consumption.
In addition, the Commission adopted two new regulations dealing with eggs. The first makes it illegal to strip or remove eggs from fish taken from waters of this Commonwealth except for trout and salmon taken from the Lake Erie watershed. The second makes it unlawful to possess or use as bait unpreserved, refrigerated or frozen fish eggs regardless of their origin while fishing in or along the waters of the Commonwealth, except that unpreserved, refrigerated or frozen fish eggs from trout or salmon may be used in the Lake Erie watershed.
In other action, the Commission approved the publication of a notice of proposed rulemaking adding the salamander, rabbitsfoot, and snuffbox mussels to Pennsylvania’s endangered species list and the sheepnose and rayed bean mussels to the threatened species list. All of these species are at risk of extinction and require varying levels of elevated attention to reverse their declining populations.

Ok now these new egg laws make for some serious crazyness. From the way I understand it the only fish that you can keep the eggs from are trout or salmon but only ones from the lake or tribs of erie. So basicaly if someone caught a nice trout anywere else in the commonweath they can not keep its eggs? That makes no sence to me..Also the way I understand it is you can use fish eggs for bait anywere in the commonweath as long as they are preserved A.K.A cured And canonly use uncured ones in the tribs or lake erie, But who is the one that determins they are cured of not?

if the eggs contain mercury it's from the lake

humm....sory but I use what works best at the time am not and never will be purist. Nothing wrong with using flys just want to keep all legal options open to me. Also I am eggsac everyone knows that if I stop using eggs then I will have to change my nickname..not happening....

So I guess you have to take the fish home.
Milk the eggs in your kitchen.
Cure them.
Then claim you got them from fish in the Lake Erie watershed?

Ya kind of messed up the way its worded as well. Basicaly says you better not ever kill and clean any female fish of any type when they have eggs or you have broken the law..well guess my spring panfishing is about over then...not....What bozzo words these laws?

No more keeping trout eggs in the spring for catfish in the summer then, unless I preserve them.  I guess if skein-ize those trout eggs with boraxo I'll be OK.  I have a couple of friends that fry those eggs and eat them, real hillbillys my friends (and some of my family) is.  They want Steelhead eggs more than they want the flesh.

So whats the verdict can you still buy king eggs at poorrichards or brownie eggs and still make your own sacs ???   or is it illegal now to do so can some please give me a answer to that. So does that mean you are no longer to use or possess eggs sacs period on the lake Erie tribs ?????

And if you keep a couple fish which i am almost 100% C&R anyways but if i would keep one here or one their and i take it to get cleaned and it has eggs in it am i breaking the law beacuse it's full of eggs....If thats the case their is going to be alot of people gettting fines... I can see taking eggs from the lake Erie watershed and using them in other water sheds,,,that's a no,no. but in The tribs i see nothing wrong with it people have been using sacs for a long time...But come on before long they will say you can't even use weight anymore or have a shot limit...I use micro shot anyways but the rules are get to be B.S. I can see rules and regs,,,but getting little picky. Did rendell have something to do with that lol.

My understanding is you can use eggs in the tribs but nowhere else in the state. Sucks because steelie eggs were killer on the stockies in the spring and cats over the summer but with the possibility of transporting VHS its probably a good idea to keep them somewhat contained.


Another reason I think its in effect is lots of guys are just sqeezing the eggs out and letting the fish go pretty much dead. All they care about is getting the eggs, whether it be to sell them, eat them or use them for bait.

MORONS  will still be using the eggs and other Erie bait inland though.
You can bet the disease will spread inland
because of the IDIOTS that think it's no big deal or they just plain don't give a chit
